Secrets Your Favorite Bar Doesn’t Want You To Know

Home / Auto Accidents / Secrets Your Favorite Bar Doesn’t Want You To Know

It’s Friday, five o’clock and it’s time for a drink at your favorite bar. Although the bartender and even the bar manager may know your name, there are certain things about the law that they REALLY don’t want you or ANYONE else to know.

You Can Sue Your Bar If They Made You Drunk and You Hurt Yourself In A Car Crash

It’s true. If you’re hurt in a car accident after your bartender served you too much alcohol, you actually have a case against the bar, even if you were the one who was at fault for the car accident. See, bartenders and servers all must abide by what is known as the Texas Dram Shop Act under the Texas Alcoholic Beverage Code. Under this law, a restaurant or a bar is liable for damages if:

(1) at the time the provision occurred it was apparent to the provider that the individual being sold, served, or provided with an alcoholic beverage was obviously intoxicated to the extent that he presented a clear danger to himself and others; and

(2) the intoxication of the recipient of the alcoholic beverage was a proximate cause of the damages suffered.

Drinking and driving is dangerous and although you may end up with DWI after your crash, you may still be entitled to damages from the bar that got you drunk. This law also applies to victims of a drunk driver crash, allowing them to recuperate damages for their injuries from the same bar.

If this has happened to you, fortunately, the McAllen Dram Shop Lawyers at Moore Law Firm are here to help. We represent clients who have been injured due to bars overserving them alcohol and fight for compensation for their damages. The “We’re Not Responsible For Any Accidents” Signs Are Worthless In The Eyes of the Law

We’re sure you’ve seen these signs before, hung on entrances or somewhere prominent where guests can read them. The problem is, they actually have little to no enforcement whatsoever. If you injure yourself from, hypothetically, slipping on some spilled water or a bar rag on the floor, you very much have a claim against your bar and they are VERY much responsible for these types of accidents. Unfortunately, many people don’t know their rights and simply believe the sign, never holding the bar rightfully accountable for their injuries.

Our McAllen personal injury attorneys at Moore Law Firm have seen this occur time and time again, and have represented hundreds of clients who were injured in various businesses throughout the State of Texas.
